This Privacy Policy explains how DesignX Inc. (“DesignX,” “we,” “us,” or “our”) collects, uses, discloses, and protects information about you when you visit designx.co (the “Website”) or use our design services (together, the “Services”).
This Policy is referenced by, and incorporated into, our Terms. If you do not agree with this Policy, please do not use the Website.
1. Who we are
DesignX connects clients with vetted product and brand design talent. For the purposes of the EU/UK General Data Protection Regulation (“GDPR”), DesignX is the data controller for personal information collected through the Website.

2. Information we collect
2.1 Information you give us directly
- Contact and account details — name, email address, phone number, company name, and job title when you contact us, request a proposal, subscribe to updates, or book a call.
- Project information — briefs, requirements, files, and other materials you share with us to scope or deliver work.
- Scheduling information — details submitted when booking a consultation or call.
- Payment information — when you purchase through our payment or shop pages. Card details are collected and processed directly by our payment processor (see Section 6); we do not receive or store full payment card numbers.
- Correspondence — the contents of emails, forms, and messages you send us.
2.2 Information collected automatically
When you visit the Website, we and our service providers may automatically collect:
- IP address and approximate location derived from it
- Browser type, device type, operating system, and screen settings
- Pages viewed, links clicked, referring URL, and time spent on pages
- Dates and times of access
- Cookie and similar identifiers (see Section 5)
2.3 Information we receive from third parties — visitor identification
Please read this section carefully.
We use third-party visitor-identification services, including RB2B and Retention.com, which may associate your activity on our Website with other personal information those providers or their partners already hold about you — including your email address — even if you have not submitted a form or otherwise identified yourself to us.
We, or service providers acting on our behalf, may then send communications and marketing to those email addresses.

- Deliver design services and manage client relationships
- Process payments, invoicing, refunds, and related records

- Analyse Website usage and measure the effectiveness of our marketing
- Detect, investigate, and prevent fraud, abuse, or security incidents
- Comply with legal obligations and enforce our Terms
Legal bases (EEA/UK). Where GDPR applies, we rely on: contract (to provide Services you request), legitimate interests (to operate, secure, analyse, and market our business proportionately), consent (for certain cookies and marketing, where required), and legal obligation (for tax, accounting, and compliance records). Where we rely on consent, you may withdraw it at any time.
4. How we share information
We do not sell personal information for money. We may share it with:
- Service providers and processors who host, operate, analyse, secure, or support the Website and our business, under contractual confidentiality obligations
- Payment processors to complete transactions
- Design professionals and contractors engaged to deliver your project, limited to what is needed to perform the work
- Professional advisers such as accountants, auditors, and lawyers
- Authorities or third parties where required by law, legal process, or to protect rights, safety, or property
- Acquirers in connection with a merger, acquisition, financing, or sale of assets
Some jurisdictions (including California) define “sale” or “sharing” broadly enough to include certain advertising and visitor-identification practices. See Section 8 for your rights and how to exercise them.
5. Cookies and similar technologies
We and our partners use cookies, pixels, tags, local storage, and similar technologies to operate the Website, remember preferences, measure performance, and support marketing — including the visitor-identification services described in Section 2.3.
Most browsers let you block or delete cookies through their settings. Blocking some cookies may affect how parts of the Website function. Where required by law, we obtain consent before setting non-essential cookies.

The Website currently relies on the following providers, each of which may process limited personal information on our behalf or as an independent controller:

7. International transfers
Our Website is hosted in the United States, and information is processed in Delaware, United States. If you access the Website from the EEA, the UK, Asia, or elsewhere, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction.
Where required, we use appropriate safeguards for such transfers, including the European Commission’s Standard Contractual Clauses. By continuing to use the Website, you consent to this transfer and processing as described in our Terms.

Depending on where you live, you may have the right to:

- Correct inaccurate or incomplete information
- Delete your personal information
- Port your information to another provider
- Object to or restrict certain processing, including direct marketing

- Be free from discrimination for exercising these rights
How to exercise them: email contact@designx.co with your request. We will verify your identity before responding and will reply within the timeframe required by applicable law. You may use an authorised agent where permitted.
Marketing opt-out: click “unsubscribe” in any marketing email, or email us.
Visitor-identification opt-out: use the RB2B and Retention.com links in Section 2.3.
If you are in the EEA or UK, you also have the right to lodge a complaint with your local supervisory authority.
9. Data retention
We keep personal information only as long as needed for the purposes described in this Policy — including to provide Services, maintain business and financial records, resolve disputes, and comply with legal obligations. Retention periods vary by record type; when information is no longer needed, we delete or anonymise it.
10. Security
We use administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission or storage over the internet is completely secure, and we cannot guarantee absolute security.
11. Children’s privacy
The Website and Services are intended for business users and are not directed to children. We do not knowingly collect personal information from children under 16. If you believe a child has provided us information, contact us at contact@designx.co and we will delete it.
12. Third-party links
The Website may link to third-party sites and services we do not control. This Policy does not apply to them, and we are not responsible for their content or privacy practices. Please review their policies directly.
13. Changes to this Policy
We may update this Policy from time to time. When we do, we will revise the “Last updated” date above and, where required by law, provide additional notice. Your continued use of the Website after changes take effect constitutes acceptance of the revised Policy.
